These Terms of Use ("Terms") govern your use of AviAlert ("the App"). By downloading, installing, or using the App, you agree to these Terms.

1. What AviAlert Is (and Is Not)

AviAlert provides tools, data displays, and educational features that may support planning and awareness in mountain/backcountry environments. It does not guarantee accuracy, completeness, or safety and does not replace training, experience, or official forecasts.

2. User Responsibility

You are responsible for:

Your decisions, actions, route choices, and risk management
Verifying information using multiple sources
Using appropriate equipment and best practices
Obtaining appropriate training from certified professionals if applicable

Reliance on the App is at your own risk.

3. Sensors, Devices, and Data Limitations

The App may use phone sensors and third-party data. Sensors/software can be inaccurate or fail. Data can be delayed, incomplete, or incorrect.

4. Offline-First and Availability

Some features work offline; others require connectivity. We do not guarantee continuous availability.

5. Subscriptions and Billing

If you purchase a subscription:

Billing is handled by Apple and may auto-renew unless canceled.
Manage/cancel subscriptions in Apple ID settings.

6. License and Restrictions

We grant you a personal, non-transferable license to use the App. You agree not to:

Reverse engineer, decompile, or extract source code
Circumvent access controls
Use the App in violation of laws or others' rights
Use access/data to develop a competing product

Violation may result in immediate termination without refund.

7. Third-Party Services and Links

The App may integrate third-party services whose terms and privacy policies also apply.

8. Disclaimers

The App is provided "AS IS" and "AS AVAILABLE." To the max extent permitted by law, we disclaim all warranties, express or implied.

9. Limitation of Liability

To the extent permitted by law, AviAlert and 663081 BC LTD shall not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits/data. Our total liability will not exceed the amount you paid for the App in the prior 12 months (or $0 if you paid nothing).

10. Indemnity

You agree to indemnify us from any claims arising from misuse of the App or violation of these Terms.

11. Governing Law

These Terms are governed by the laws of the Province of British Columbia and Canadian law.

12. Changes

We may update these Terms; continued use after changes means acceptance.
