1) High-risk activity warning

Backcountry travel, avalanche terrain travel, and mountain activities involve serious risk of injury or death. Conditions can change rapidly, and hazards may be difficult to detect.

2) No safety guarantee

AviAlert provides informational and educational tools. It does not guarantee your safety, and it does not determine whether any terrain, route, slope, or decision is safe. The App may be incorrect, incomplete, delayed, or unavailable.

3) You must verify and use multiple sources

Do not rely on AviAlert as a single source of truth. You should use multiple sources of information, including:

  • Official avalanche and weather forecasts
  • On-site observations
  • Appropriate training and professional instruction
  • Proper equipment and group decision-making

4) Sensor and AI limitations

Mobile devices and sensors can fail or provide inaccurate data. Software, maps, and AI features can produce errors or misleading outputs. You are responsible for verifying information and making decisions accordingly.

5) Assumption of risk

By using AviAlert, you acknowledge and accept that the activity you are engaged in is inherently dangerous, the App may be inaccurate or fail, and you assume all risks arising from your use of the App, including reliance on information displayed by the App.

6) Release and waiver (to the maximum extent permitted by law)

To the maximum extent permitted by applicable law, you agree to release and discharge 663081 BC LTD (doing business as gearheadlabs), its directors, officers, employees, contractors, and agents from claims or liabilities arising from your use of the App, including claims based on alleged inaccuracies, omissions, or failures. Some jurisdictions do not allow certain limitations or waivers. Where such limitations are not permitted, they will apply to the fullest extent allowed.

AviAlert is not an emergency service and does not guarantee emergency communications or response.
